Course Gateway Terms and Conditions


Course Gateway by TAFE Queensland is TAFE Queensland's online micro‑credential, where students and industry users can browse, enrol in, and complete self‑paced, non‑accredited training programs.


By purchasing, enrolling or accessing TAFE Queensland's Course Gateway courses, you agree to these terms and conditions (Terms and Conditions).


1. ENROLMENT AND PAYMENT

TAFE Queensland (TQ) offers both Government funded and paid courses through this platform. Your obligations will differ depending on the type of course you choose:


Government funded Courses

• Funded courses do not require payment, however, you may be required to adhere to eligibility criteria to access the course at no charge and provide additional details for reporting purposes prior to accessing the course material.

• You must create a user account to access course content.

• After account creation, you will be able to enrol and access the course immediately through your Course Gateway account dashboard. You will also receive an order confirmation email with details on how to access the course.

• If you are facilitating a licence for someone else, or multiple licences (bulk licences), you will be granted access to the Licence Management dashboard, where you can allocate licences to learners.

o All licence allocations are managed by the administrator account, and once allocated, licences are non-transferable (unless otherwise specified).


Paid Courses

• Full payment is required at the time of enrolment.

• You are required to pay the total amount of the course fees even if you do not complete your course.

• Course fees will include the necessary e-learning resources, such as online interactive resources, online PDFs, or workbooks, depending on the course of study chosen.

• Course fees are displayed on each course product page.

• TQ may update course fees from time to time, with changes effective for new enrolments only.

• Once your payment is successfully processed, you will be provided access to the course through your Course Gateway account dashboard. You will also receive an order confirmation email with details on how to access the course.

• If you purchased a licence for someone else, or purchase multiple licences (bulk licences), you will be granted access to the Licence Management dashboard, where you can allocate licences to learners.

o All licence allocations are managed by the purchasing account, and once allocated, licences are non-transferable (unless otherwise specified).


2. REFUNDS

This section describes TQ's refund policy for courses purchased through Course Gateway.


Paid courses

Paid courses are not refundable or transferable, unless otherwise stated in the course information or agreed in writing by TQ.


Your rights under the Australian Consumer Law (ACL) always apply. This means you may be entitled to a refund or another remedy if, for example, a course is not provided with reasonable care and skill or is not delivered as advertised.


Bulk Licences

Once bulk licences have been allocated to learners, refunds are generally not available for any unused licences. This includes circumstances where licences are issued to an incorrect email address, allocated to the wrong learner or where a learner leaves the organisation after the licence has been allocated, or otherwise fails to complete the course. As with all paid offerings, ACL rights continue to apply where relevant.


Submitting a Refund Request

If you believe you may be entitled to a refund or require assistance with your enrolment, please submit a request through the Course Gateway Contact Us form. Our team will review your request and respond as promptly as possible.


3. COURSE CONTENT AND USE

Courses are delivered entirely through an online learning environment. Course materials may be accessible only through the platform and are not downloadable.


All online course content, including text, graphics, videos, assessments, data, software, and any other materials, is protected by copyright and other intellectual property rights. This includes any third‑party content made available on or through the platform.


All such rights remain the exclusive property of TQ, its licensors, and any relevant third‑party rights holders.


You may access and use course content solely for your personal, non commercial learning purposes. You must not copy, reproduce, republish, download, distribute, modify, adapt, disassemble, decompile, reverse engineer, broadcast, transmit, make publicly available, or otherwise use any TQ or third party content in any manner that goes beyond your own study or is inconsistent with applicable rights.


4. COURSE EXPIRY AND ACCESS

Some courses may have a specified expiry date. If applicable, you are responsible for completing all course requirements before the course expiry date (Course Expiry).


If you do not complete the course before the Course Expiry, your enrolment will end and you may lose access to the course. Subject to your rights under the Australian Consumer Law, you will not be entitled to any refund or partial refund of course fees.


TQ may suspend or permanently remove your access to the Course Gateway platform if:

• You do not complete the course by the Course Expiry.

• You breach these Terms and Conditions;

• You misuse course materials;

• The course is discontinued;

• You engage in misconduct or unlawful behaviour (as determined by TQ).


5. COURSE COMPLETION

The courses available through Course Gateway are non‑accredited micro‑credential courses, meaning they do not lead to a nationally recognised qualification.


Where assessments are included, they are provided for learning and skills‑development purposes only.


TQ does not guarantee completion outcomes, employment opportunities, or industry accreditation as a result of undertaking these courses.


Upon completion of a course TQ may, at its discretion, issue a digital badge.

6. COURSE CHANGES AND UPDATES

TQ is committed to ensuring that its courses remain current and relevant. To achieve this, we may update, refine, or amend course content from time to time so that it continues to reflect the latest industry practices and standards. We may also discontinue courses at our discretion, for example where funding expires, content becomes outdated or is replaced by newer learning options.


7. STUDENT CONDUCT

Upon enrolling in a Course Gateway course, you become a TQ student. As a TQ student, you are expected to:

• Provide all information and complete any actions required during the enrolment process.

• Communicate with others online in a courteous, respectful and fair manner.

• Contribute to a safe, inclusive and supportive online learning environment.

• Refrain from behaviour that may be perceived as unsafe, intimidating, discriminating, harassing, bullying or disruptive to others.

• Use TQ's online systems, platforms and learning materials responsibly and only for lawful and educational purposes.

• Engage actively and positively in learning and assessment activities.


8. PLATFORM AVAILABILITY AND SYSTEM REQUIREMENTS

While TQ aims to provide reliable access to the Course Gateway platform, you acknowledge that the platform is provided on a software‑as‑a‑service basis and its availability and performance may be affected by factors outside TQ's control.


While TQ uses reasonable efforts to provide reliable access to the Course Gateway platform, TQ does not guarantee:

• Uninterrupted or continuous platform availability;

• Error free content;

• Compatibility with all devices, operating systems or browsers.


You acknowledge that:

• TQ may conduct maintenance, updates, or changes to the Course Gateway platform at any time.

• TQ may suspend access to the Course Gateway platform temporarily for technical or operational reasons.

9. PRIVACY

Queensland has privacy legislation which applies to the Queensland public sector - the Information Privacy Act 2009 (Qld) (IP Act). The IP Act contains privacy principles which set out how agencies may and must handle personal information.


TQ respects your privacy and is committed to protecting your personal information. Our Privacy Policy explains how we collect, hold, use and disclose personal information in accordance with the IP Act.


By providing your personal information to TAFE Queensland, you consent to its collection, use, storage and disclosure as outlined in our Privacy Policy.

10. FEEDBACK AND SUPPORT

TQ is committed to continually improving its quality of service. You are encouraged to provide feedback to TQ about its operations and the quality of education and training you are receiving.

11. LIABILITY AND DISCLAIMER

To the extent permitted by law, TQ does not guarantee that your use of the Course Gateway platform will:

• be compatible with all hardware, devices, or software;

• be uninterrupted, error free, or free from viruses or other harmful components;

• produce any specific learning, employment, or personal outcomes; or

• be free from defects, except where we are legally required to remedy those defects.


You are responsible for taking reasonable steps to protect your devices, including regularly checking for and safeguarding against viruses and other security risks.


The Course Gateway platform may include content, links, or materials provided by third parties. TQ does not guarantee the accuracy, suitability, or availability of any third party content and is not responsible for any issues arising from your access to or use of such materials.


To the fullest extent permitted by law, we exclude all warranties, terms and conditions, whether express, implied, or statutory, relating to the quality, accuracy, or fitness for purpose of the Course Gateway platform or its content.

We also exclude all liability for any direct, indirect, incidental, consequential, or special loss or damage (including economic loss, loss of profits, business interruption, or loss of goodwill) arising from your use of the Course Gateway platform or its content, whether in contract, tort, strict liability, or otherwise.


Nothing in these Terms and Conditions limits your rights under the Australian Consumer Law, and these exclusions apply only to the extent permitted by that law.


12. GUARANTEES UNDER THE AUSTRALIAN CONSUMER LAW

Our courses and related services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms and Conditions limit your rights under the ACL. In particular, our services must:

• be provided with due care and skill;

• be fit for any purpose you told us about and that we agreed to; and

• be delivered within a reasonable time if no timeframe is agreed.


If there is a major failure with the service, you are entitled to choose either a refund or to have the service provided again. You may also be entitled to compensation for any other loss or damage that was reasonably foreseeable. If the failure is not major, you are entitled to have the issue remedied within a reasonable time; if it is not remedied within that time, you may choose to have the issue resolved by another provider and claim reasonable costs, or you may request a refund.


Where permissible, TQ's liability in relation to a failure to meet a consumer guarantee under the ACL is limited to:

• supplying the services again; or

• the payment of the cost of having the services supplied again.


13. UPDATES TO TERMS AND CONDITIONS

We may update these Terms and Conditions from time to time. When this happens, we will publish the updated Terms and Conditions on the Course Gateway platform so you can review them at any time.


We will let you know about important changes (for example, through a notice on the platform) so you can understand what has changed.


If you continue to use the Course Gateway platform after the updated Terms are published, it means you accept the new version. If you do not agree with the updates, you may stop using the platform and contact us to discuss available options.


14. SEVERABILITY

If any part of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that part will be removed. The remaining provisions will continue in full force and effect.


15. ENTIRE AGREEMENT

These Terms and Conditions constitute the entire agreement between you and TQ in relation to your use of the Course Gateway platform and supersede all prior agreements, understandings or representations, whether written or oral, relating to the same subject matter.


16. GOVERNING LAW

These Terms and Conditions are governed by the laws of Queensland. You agree that the courts of Queensland have exclusive jurisdiction to hear and determine any disputes arising in connection with these Terms and Conditions.
